Director penalty notice FAQs
As a company director, you’re responsible for ensuring all tax and super obligations are reported and paid on time. A director penalty notice will be issued when the ATO needs to recover penalty amounts from the Director.
You will have 21 days to pay the full penalty amount, negotiate a payment plan with the ATO, or enter an alternative arrangement. The sooner you contact us, the more options you’ll have as a director.
There are two types of DPNs: a non-lockdown DPN and a lockdown DPN. A non-lockdown DPN allows directors to avoid personal liability by paying the debt or placing the company into voluntary administration or liquidation within 21 days. A lockdown DPN means the directors are personally liable for the debt regardless of the company’s actions.
In very limited circumstances yes, but in most cases no. While you probably cannot appeal the issuance of your DPN, you can take action to comply with its requirements within the specified timeframe to avoid personal liability.
If you cannot pay the full penalty amount, as your accountant, we need to immediately contact the ATO on your behalf to discuss payment plan options or other potential resolutions.
Receiving a DPN itself does not directly impact your credit rating. However, if the ATO takes legal action to recover the debt and obtains a court judgment against you, this can negatively affect your credit rating.
Every situation is different and as your business accountants we will need to have a detailed look at your specific situation. Your options may include: 1) repaying the debt in full, 2) repaying a part of the debt, 3) liquidating your company, 4) entering into administration, 5) entering a payment arrangement.
